City of West Palm Beach Mobility Fee

On May 27th, 2025, the City of West Palm Beach adopted Ordinance 5130-25, which established a Mobility Fee for Downtown based on mobility projects from its adopted 2018 Mobility Plan and updates to the 2025 Downtown Mobility Plan. The Downtown Mobility Fee is intended to be an alternative transportation system consistent with Florida Statute Section 163.3180. The Downtown Mobility Fee replaces the Palm Beach County transportation concurrency system and the Palm Beach County road impact fee and will be the only fee to mitigate transportation capacity impacts from new development within the Downtown Mobility Fee Assessment Area.

Mobility Fees are:

  • a streamlined one-time assessment on “new development” within the Downtown Mobility Fee Assessment Area;

  • intended to offset the travel demand impact of new development; and

  • deposited into a special revenue fund for mobility fees to be expended within the Downtown Mobility Fee Benefit District.

 

New Development is defined as “new residential and non-residential construction, any new land development or site preparation activity, any new construction of buildings or structures, any modification, reconstruction, redevelopment, or upgrade of buildings or structures, any change of use of a building, land, or structure, and any special exception approval, variance, or special use permit that results in an impact to the transportation system.”

Impact is defined as "any new development that results in an increase in person travel demand above the demand generated by the existing use of property, including submerged lands."

The mobility fee features a single Assessment Area within Downtown West Palm Beach (Map A).  The Assessment Area defines where new developments will be assessed a mobility fee at the time of building permit application. The Assessment Area includes City’s Downtown Master Plan area, along with several parcels south of Okeechobee Blvd between Dixie Highway and Flagler Drive.

 

The mobility fee system has been developed to assess a uniform mobility fee rate for each land use on the mobility fee schedule. Mobility fees are to be paid at the time a building permit is issued by the City.

 

The development of a Downtown Mobility Fee is the first step in the process of the City transitioning away from transportation concurrency and road impact fees. The second step will be development of a West Palm Beach Mobility Plan and Mobility Fee for areas of the City outside of Downtown.
