Surplus Property for Affordable Housing Purposes
According to Section 166.0451, Florida Statutes, the City of West Palm Beach is required every three years to adopt an inventory list of all real property within the city to which the City holds fee simple title that is appropriate for use as potential affordable housing. "Affordable housing" is housing that is affordable by a person or family whose then-current family income does not exceed 120% of the then-current area median gross income for the West Palm Beach and Boca Raton Metropolitan Statistical Area.
In furtherance of the City's affordable housing objectives and under the City's Housing Assistance Incentives Program as approved by Resolution No. 75-18(PDF, 7MB) , the Department of Housing and Community Development is authorized to dispose of the properties for affordable or workforce housing purposes with the advice and consent of the Mayor. The methods of disposition may include sale of the properties with the proceeds going to the Housing Trust Fund; transfer of properties, at no cost, to a non-profit for the development of affordable housing; sold to non-profits or private parties with a provision that the property be used for an affordable or workforce housing projects; or the City may retain the properties to build or preserve affordable or workforce housing units.
Section 2-31(27)(b) of the City's Code of Ordinances, requires that prior to the disposition of City property, the City Commission shall: (i) make a legislative finding that the City property is not needed for City purposes and declaring the property surplus; and (ii) select the method of disposition as stated above.
In 2023, via Resolution 244-23(PDF, 256KB) , the City Commission declared the following properties as surplus and determined that they are suitable for affordable housing purposes*:
